AMAPCEO Internal Review of Workplace Dispute (Grievance Decision and Appeal Process)

How Decision is Made to Carry Dispute Forward to Arbitration Stage:

After receiving stage two response from Employer, the AMAPCEO Workplace Relations Committee (WRC) reviews and makes a recommendation on legal support of the dispute to arbitration based on defined criteria. The AMAPCEO Executive reviews the WRC's recommendation and either upholds or rejects the recommendation.

Arbitration Approved 

  • Staff officer notifies complainant and files for arbitration to the Grievance Settlement Board.
  • Reports to WRC that dispute is proceeding

Arbitration Denied 

Staff officer notifies complainant of:  

  • decision to deny support
  • complainant's right to appeal this decision to the AMAPCEO Board
  • obligation of complainant to indicate in writing to Secretary of Association, within 5 working days of being told of decision, intention to appeal decision
  • option to submit documentation, and/or appear before the Board in-person (at complainant's expense) or by teleconference

No appeal
