AMAPCEO Internal Peer Review of Workplace Dispute (Grievance Decision and Appeal Process)
How Decision is Made to Support Dispute at Stage 2:
After consultation with complainant and Workplace Representative, a Dispute Resolution Officer (DRO) brings a dispute forward to the Designated Officials (D.O.'s) to review and make a decision on whether to support dispute at Stage Two. Note: Should it be determined that AMAPCEO will support a dispute at Stage Two, the Dispute Resolution Officer will be charged with carrying the dispute forward to Stage Two.
Approve
- DRO notifies complainant and files stage two dispute form with employer
- DRO reports to WRC and to the Ministry AMAPCEO AMERC Co-Chair that the dispute is proceeding
Deny - Automatic Review to Workplace Relations Committee (WRC)
DRO notifies complainant of:
- D.O.'s decision to deny
- automatic review by WRC
- right to send in additional material for WRC review
- WRC meets to review the denial
WRC Overturns Denial
- DRO files stage two dispute with employer
- Report to Executive and Board
OR
WRC Upholds Denial
- Decision Final
- Dispute does not proceed, DRO reports decision to complainant and to the Ministry AMERC Co-Chair
- WRC reports to Executive and Board
